Leasing land to BayWa r.e.: How does it work?

How does leasing land to BayWa r.e. work for a renewable energy project?

At the start of the project development, a contractual agreement is signed between the landowner, the agricultural operator (if applicable), and BayWa r.e. This agreement outlines the following elements: emphyteutic leases, easement agreements, and partial termination of agricultural leases. It also enables BayWa r.e. to conduct the necessary surveys for the development of a renewable energy farm.

During the survey phase, as the landowner, you will sign a lease agreement. This document allows BayWa r.e. to reserve the land area for study.

Once the project is authorised, you will sign a lease through notarised documents for the parcel of land designated for the final implementation of the project. This lease is then valid during the entire phase of construction and operation. Throughout the operational phase, you will retain ownership of the land and receive lease revenue.

At the end of the farm's operational life, the land is restored to its original condition. BayWa r.e. commits, from the lease promise agreement phase, and in compliance with environmental regulations, to fully dismantle the wind farm, solar farm, or storage facility (including wind turbines, solar panels and their supports, removal of the delivery station, and complete removal of foundations) at its own expense and to restore the site to its original condition.
